Abbas (R.A) ya ce, Manzon Allah (ﷺ)
ya ce, "Da za a bai wa mutane dukkan da'awarsu, da waɗansu sun yi da'awar dukiyar waɗansu da jininsu, sai dai hujja tana kan mai da'awa,
rantsuwa kuma a kan wanda ya yi musu." Baihaƙi
ne ya rawaito shi a cikin littafinsa Sunan (J 10/ sh 252). Wani sashi na
hadisin yana cikin Bukhari da Muslim.
SHARHI
Ma‘ana, da duk da'awar da mutane za su yi, za a ɗauka a ba su wannan abin da suka yi da'awa, misali
in sun ce kaza namu ne, a ba su, ba tare da shaida ba, ba tare da an bincika
ba, "....da waɗansu
sun yi da'awar dukiyar waɗansu...."
da sun yi da‘awar jinin wasu. Sai Annabi (ﷺ)
ya ce, "....sai dai hujja tana kan mai da’awa...." Ma'ana; ana neman
mai da'awa da ita, wanda kuma ake nema da ya yi rantsuwa, shi ne wanda ya yi
musu. Abin nufi, idan na zo na ce motar da wane yake hawa tawa ce, ni na ba shi
rance, ya hana ni, wannan abin da na yi, da'awa ce, to a shari‘ance kafin a yi
hukunci, ana neman in kawo shaida. Idan na kawo shaidu, suka tabbatar da wannan
tawa ce, dole a karɓe
wannan mota a ba ni, a shari'ance. Shi kuma in ya yi inkari, ya ce sam! duk da
shaidar nan da na zo da ita bai yarda ba, to sai ya yi rantsuwa, don a tabbatar
da haka ne. Wato dai kullum mai da'awa shi ne ake bin
bashin dalili, idan mutum ya yi da'awar abu kaza
haramun ne, shi za a ce ya kawo dalilinsa; idan mutum ya yi da'awar halacci a
cikin abin da asalinsa haramci ne, to wannan shi za a nemi ya kawo dalili.
Wannan hadisi asalinsa mai girma ne ƙwarai
da gaske, yana shiga babuka da dama, musamman ma babin da ya shafi haddi, babin
da ya shafi rigingimu a tsakanin mutane da rigimar dukiya. Hadisin dai yana
shiga babi da dama na fiƙihu da babin
ma'amaloli.
